SIDELINE CONNECT:

TERMS AND CONDITIONS – SPORTS PHOTOGRAPHY & VIDEOGRAPHY BOOKINGS

By making a booking for photography and/or videography services, you acknowledge and agree to the following terms and conditions:

1. Booking Confirmation

1.1 A booking is only confirmed once full payment, together with proof of payment, has been received.

1.2 Payment and proof of payment must be submitted within at least 24 (twenty-four) of making your booking .

1.3 Failure to provide payment and proof of payment within the required timeframe may result in cancellation of the booking.

1.4. Bookings should be made at least 73 hours prior to the game in order for us to confirm your booking and secure payment. We cannot guarantee availability should you provide short notice you are required to contact our offices directly and ensure availability telephonically before making payment.

1.5. Fees vary based on the photographer booked, please check the website and ensure that you have selected the correct type of booking as we do team bookings, individual bookings and club/school bookings and these amounts vary according to distance, time required and photographer selected.

2. Match Participation Requirement

2.1 Photography and/or videography services are dependent on the player participating in the game.

2.2 If the child does not play during the match for any reason whatsoever, no refund, credit, or

rescheduling will be provided.

2.3 The photographer/videographer is contracted to attend the scheduled event and reserves time exclusively for the booking.

3. Scope of Coverage

3.1 Coverage is limited to official game time only.

3.2 Photographs and videos will primarily focus on moments where the player is actively involved in play, including when the player has possession of the ball or is directly participating in the action.

3.3 The number and quality of images captured may vary depending on game conditions, player participation, weather, lighting, venue restrictions, and overall match activity.

3.4. Kindly note that your fees for a private booking will cover up to 10-15 images of your child during the game.

4. Game Cancellations and Refunds

4.1 If a game is cancelled, postponed, or rescheduled, at least 24 (twenty-four) hours’ notice must be provided in order to qualify for a credit to be applied to your next booking. The credit will however only remain valid for 2 months from date of cancellation.

4.2 Where less than 24 hours’ notice is provided, no refund will be granted, as photographers/videographers travel to scheduled games and decline other bookings based on confirmed appointments.

4.3 Refunds, where applicable, will be processed within a reasonable period.

5. Access to Photographs and Videos

5.1 Access to photographs and/or videos will only be provided once payment has been received in full.

5.2 In the case of group bookings where the booking fee is shared and photographs are purchased individually at a later stage, access may be granted for selection purposes only, after which payment must be made before final downloads or delivery are provided.

6. Unauthorized Use and Screenshots

6.1 Screenshots, copying, downloading, sharing, or use of unpaid preview images is strictly prohibited.

6.2 Any player, parent, or client found screenshotting or using photographs without payment will be blacklisted from future bookings.

6.3 Blacklisted individuals may be refused future photography or videography services by our photographers and affiliated service providers in future as the images are the intellectual property of the photographer and remain their property until fully paid for.

7. Consent to Capture and Display Images

7.1 By making a booking, you hereby consent to Sideline Connect, the photographer/videographer capturing, storing, editing, uploading, displaying, and sharing photographs and/or videos of your child for purposes related to the service provided.

7.2 Images may be uploaded to online galleries or platforms for viewing, selection, and purchase purposes.

7.3. The photographer/videographer and Sideline Connect may use the captured images for purposes of promotion and advertising on social media. Should you not consent to same, kindly ensure that you stipulate that you do not consent to this in writing when making your booking, as several players ask the photographer/videographer to post them on social media and therefore the photographer will require written communication as a precautionary measure to ensure that they are aware of your request not to post.

8. Protection of Personal Information (POPIA)

8.1 In accordance with the Protection of Personal Information Act, 4 of 2013 (“POPIA”), all personal information collected will be processed lawfully and responsibly.

8.2 Personal information collected may include:

• Parent or guardian names;
• Contact details;
• Player names;
• Team or club information;
• Photographs and video recordings.

8.3 Such information will only be used for:

• Booking administration;
• Communication regarding bookings;
• Delivery and management of photographs and videos;
• Client service purposes;
• Displaying and sharing galleries with authorized clients.

8.4 By making a booking, the parent or legal guardian consents to the collection, processing, storage, and use of the child’s photographs and related personal information for the purposes outlined above.

8.5 Reasonable technical and organizational measures will be taken to safeguard personal information and digital content against unauthorized access, loss, misuse, or disclosure.

8.6 Clients acknowledge that photographs uploaded to online galleries or shared digitally may be accessed, shared, downloaded, or distributed by third parties beyond the reasonable control of the photographer/videographer. While precautions are taken, no guarantee can be provided against unauthorized distribution once access has been granted this is especially difficult to control where

the photographer is capturing images of a team, school or club booking.

8.7 Clients may request access to, correction of, or deletion of personal information, subject to applicable legal and contractual obligations.

9. Third-Party Sharing

9.1 While reasonable measures are taken to protect photographs and videos, we are not responsible for the display, sharing, forwarding, downloading, reposting, or distribution of photographs by other players, parents, teams, or clients once access has been granted.

10. Limitation of Liability

10.1 We shall not be held liable for:

• Missed moments due to gameplay circumstances i.e should your child not be selected to play on the day/ match;
• Poor visibility, weather, lighting, or venue restrictions;
• Technical failures beyond reasonable control;
• Injuries, match interruptions, or shortened game time;
• Actions of third parties relating to the sharing or misuse of photographs.

11. General

11.1 We reserve the right to refuse or cancel bookings where these terms and conditions are breached.

11.2 By proceeding with a booking and payment, you confirm that you have read, understood, and agreed to these Terms and Conditions.

11.3 These Terms and Conditions shall be governed in accordance with the laws of the Republic of South Africa.

11.4 Sideline Connect is a platform for booking of photographers, videographers and we provide samples on our website of the work previously done by these service providers, kindly ensure that you have checked the quality of work produced by such parties before booking a photographer or videographer. We will not be held liable for any dissatisfaction with the quality of work provided, should you have any requests or feel dissatisfied with the quality of work you are required to address this with the photographer or videographer directly and within 48 hours of receiving your link for downloads.
